Switzerland may re-export arms

The parties SP, Mitte, FDP and GLP have had a legal opinion carried out to unblock the war material debate. Now it’s here – and the content is explosive, as reported by “Switzerland at the Weekend”.

International law professor Peter Hilbold from the University of Innsbruck wrote the book “Solidarity and Neutrality in the Treaty of Lisbon” and was commissioned to provide the expert opinion.

“Neutral Obligations Obsolete”

According to the newspaper, Hilpold comes to the conclusion that the neutrality law probably no longer exists in this form after the Hague Convention of 1907. “There are fundamental doubts as to whether the neutrality obligations of the Hague Agreement are still valid,” the report said. There are many indications that they are “substantively obsolete and in any event incompatible with the peace law of the Charter of the United Nations”.

Article 18 of the War Material Act prohibits the re-export of war material that Switzerland has sold to partner countries. Parties want to defuse this article with a parliamentary initiative – and are now receiving help with the report.

Freedom of action for Switzerland

Even assuming that the Hague neutrality law remains in place, the restriction on re-exports cannot be attributed to this agreement, Switzerland at the weekend continues to quote from the report. That means freedom of action for Switzerland.

The parties are happy with this: center chairman Gerhard Pfister says, for example, that the arguments of the Bundesrat become superfluous as a result. The trial run for the parliamentary initiative will follow on 11 May. That day it is on the agenda of the Security Policy Committee of the Council of States. (new)
