Switzerland can no longer send refugees back to Italy

The federal government on Wednesday extended an internal planning period by a month until the end of May, a spokesman for the Secretariat of State for Migration (SEM) told Keystone-SDA news agency when asked. The exact time when the recording freeze was lifted is not yet known. There are currently about 300 people who cannot be transferred to Italy.

Since December, Italy has refused to take back refugees for whose asylum applications it is actually responsible under the so-called Dublin agreement. Italy is reportedly violating EU law. The reason given by Italy was that it no longer had any reception capacity due to the large influx of refugees via the Mediterranean Sea.

According to the SEM, the European Commission and Switzerland are in contact with the Italian authorities to resume transfers. The European Commission could launch formal infringement proceedings against Italy as a punitive measure. So far this has not happened.

According to the SEM, a temporary admission freeze for Switzerland is manageable. The deadline for transferring Dublin cases only expires after six months. In addition, this period can be extended. The people could also be brought back later.

If the six-month period expires and is not extended and a person cannot therefore be transferred, a national asylum procedure would be followed in Switzerland, the SEM said. (SDA)
