Federal Supreme Court postpones determination of contributions for the time being

In January, the Federal Administrative Court partially approved an appeal by BKW Energie against a decision of the Administrative Commission of the Decommissioning and Disposal Fund (UK Stenfo). It referred the matter back to the Administrative Commission for reconsideration.

As the operator of the Mühleberg Nuclear Power Plant, which was closed at the end of 2019, BKW has appealed to the Federal Supreme Court against the decision of the Federal Administrative Court. This follows in a statement published on Friday from the position of the energy company that a new ruling from VK Stenfo before the completion of the current complaints procedure would not make sense for reasons of procedural economy.

Nearly 24 billion francs for decommissioning and disposal

VK Stenfo set the expected total costs for the decommissioning of the nuclear power plants and the disposal of radioactive waste in 2020 at CHF 23.856 billion. Of this, CHF 3.779 billion is earmarked for decommissioning and CHF 20.077 billion for disposal.

In its calculation, the Administrative Commission assumed that the buildings of the former installation would have to be dismantled – even if they no longer posed a radiological hazard. However, the Federal Administrative Court ruled that not only this decommissioning target, known as a “green field”, was allowed. The “brown meadow” is also allowed, where the buildings remain and can be reused.

In its complaint, BKW complained about other aspects of VK Stenfo’s decision. However, these were rejected. (SDA)
