No national form requirement: Parliament votes against transparency in rental prices

In the event of a change of tenant, there will be no obligation in the future for the whole of Switzerland to complete a form to communicate the initial rental price. The National Council has rejected a corresponding parliamentary initiative from the ranks of the Greens.

On Tuesday, the Grand Chamber did not follow the initiative of former national councilor Natalie Imboden (Greens/BE) – with 116 votes in favor to 71 against and 4 abstentions. A middle-class majority, consisting of the SVP, FDP and the Center, prevailed. With the no vote, the parliamentary initiative is over.

Michael Töngi (Greens/LU) argued unsuccessfully that the requirement for a rental form would improve transparency in the rental sector. Nowadays, prices are often increased when tenants change – the result is “far too high returns”. By systematically disclosing the rent amount of the previous tenant or landlord, tenants could more easily defend themselves against unlawful rents.

Mandatory forms are contrary to federalism

Philipp Matthias Bregy (center/US) stated on behalf of the Commission’s ruling majority that the cantons are already free to introduce a form for the initial interest of the pre-let party for their canton. Regulating the question of form at the federal level contradicts the idea of ​​federalism.

“All in all, the proposal creates more bureaucracy,” said Bregy. Tenants already have legal tools to challenge the initial rent. He also pointed out that even in the cantons with mandatory forms, there was no decrease in rental prices or increased transparency. (SDA)
