27 cases in Thun alone

In the juvenile ward of Thun prison alone, there have been 27 cases in two years. The recordings came from six cantons and the Principality of Liechtenstein. Five cases have also been committed in the Waaghof youth prison in Basel in the past two years.

The practice in the canton of Zurich is remarkable. Director of Justice Jacqueline Fehr (60) does not want young people to go to prison under civil law. At the same time, the Zurich Kesb sends young people to prison in Thun. Fehr’s spokesperson explained the contradiction to SRF by saying that the Kesb is independent – its decisions should be examined by the courts, not the Judicial Directorate.

“Nothing to do in prison”

Legally, there are doubts as to whether this practice is even allowed. Young people who have not come into contact with criminal law “have no place in prison,” says Martina Caroni (54), chair of the Anti-Torture Commission. The law professor at the University of Lucerne says young people behind bars cannot be treated in an age-appropriate manner. “That certainly contradicts the Convention on the Rights of the Child.”
