Due to election instructions: criminal charges against Rimoldi and Mass-Voll

The Mass-Voll movement, which is participating in the federal elections in ten cantons, has published voting instructions on its homepage. Under the title “How to Choose Correctly,” the movement writes: “Note: Use only the Mass-Full list. Otherwise your vote will be invalid.”

Lawyer Loris Fabrizio Mainardi from Lucerne has filed a criminal complaint with the public prosecutor’s office against Mass Voll president Nicolas Rimoldi (28) and those responsible for the movement, CH Media newspapers report.

“You can’t allow that”

Mainardi regards this formulation as an interference with voting rights. This is an actual threat of disadvantages. «Mass-Voll spread clear falsehoods. “You cannot allow that,” he told the “Aargauer Zeitung”.

Violations of the relevant article of the Criminal Code are punishable by a fine or a prison sentence of up to three years. According to CH Media, Mass-Voll has already slightly adjusted the instructions on the homepage. It now says: “Attention. Use only the Mass-Full list. Use only one list, otherwise your vote will be invalid!”

However, Mass Voll president Nicolas Rimoldi claims this has nothing to do with the criminal complaint. Instead, they received information from their own ranks that the wording might be based on “misunderstanding.”

Mass-Voll could also get in trouble at the post office for defamation. The movement’s homepage calls on people to deposit the ballot paper in the ballot box or directly at the municipality – “to make election manipulation by the Swiss Post, whose board of directors is former SP president Christian Levrat, impossible.” The Post would not disclose to CH Media what steps were taken.
