Wrong court decision in the US. In 2019, an Olivia Holmes (then 4) burned herself on chicken nuggets. Her mother Philana then sued the fast-food company — and was now on trial in a South Florida court!
The lawsuit came after mother Philana bought her two children a “Happy Meal” at the drive-in in the town of Tamarac, as “CNN” reports. When the mother drove off again, Olivia suddenly started screaming. Her mother then discovered a burn on the daughter’s leg.
Philana Holmes then photographed the injuries and also captured the baby girl’s screams. These have now been played in court and used as evidence.
The parents then filed a lawsuit against McDonald’s. The company did not warn customers enough about the “dangerously high temperatures” of the food, citing “CNN” from the suit. The daughter was “disfigured and scarred” in the incident.
The lawsuit also says the franchise company should have known the nuggets were “unfit for human consumption”. McDonald’s should never have sold the nuggets.
And indeed: both McDonalds and the franchisee in the city of Tamarac are guilty, the court ruled. The company gave no advice on how to handle hot food safely. It is still unclear how much the group will have to pay the family.
In the US there are always absurd lawsuits. American Stella Liebeck († 91) sued McDonald’s in the 1990s because she suffered third-degree burns to her thighs and crotch from hot coffee. A grand jury awarded her $2.9 million.
This McDonald’s fine was later reduced by a judge to $640,000, and the parties involved settled out of court for an undisclosed amount. (zis)
