Germany wants Russia export clause

As the German news agency DPA has learned from EU circles, the German ambassador to the EU made a similar proposal during the negotiations in Brussels on Wednesday.

As a result, companies from non-EU countries could in future contractually commit themselves when purchasing certain goods in the EU not to export them to Russia later. In addition, the importers must also ensure in writing that they will only resell these goods to other companies if they also sign a “Not for Russia” clause.

According to information from EU circles, such a rule could apply in particular to the export of goods that can be used not only for civil, but also for military purposes. These are, for example, night vision goggles and drones.

The background to the German proposal is the ongoing negotiations on an eleventh package of sanctions against Russia. It is mainly intended to prevent the circumvention of the punitive measures already issued. The European Commission has proposed, among other things, to create the legal possibility to restrict selected exports to certain third countries due to suspected circumvention of sanctions. Many products from the EU countries themselves have not been allowed to be delivered to Russia for months.

However, according to diplomats, the Commission’s proposal has not been received entirely positively by all EU countries. The danger is that some member states do not have the courage or will to put countries like China on such a list because of possible retaliatory measures. In this case, the tool would help only if its mere existence served as a deterrent. This is because the approval of all 27 EU states would be required for each country and product to be listed.

In addition to China, Kazakhstan, Armenia and the United Arab Emirates are countries used to circumvent sanctions against Russia. Turkey has recently been certified by EU experts to respond with relative resoluteness to indications of sanctions circumvention.
