The US announces new measures to manage migration

He Department of Foreign Affairs and Department of Homeland Security (DHS) from NOW announced strong new measures to further eliminate illegal migration in the Western Hemisphere.

In addition, it seeks to significantly expand the legal means of protection and enable the safe, orderly and humane processing of migrants.

Like many other public health measures that were taken during the covid-19 pandemic period, the temporary public health order in accordance with Chapter 42 ceases to be effective.

However, it is clarified that the cancellation of the order under Title 42 does not mean that the border is open.

When Title 42 is repealed on May 11 at 11:59 p.m., the United States will resume its immigration powers under Title 8 for expeditious processing and removal of persons who arrive illegally at the US border.

These powers, which have been in place for decades, provide for serious consequences for illegal entry, including a ban on re-entry for at least five years and possible prosecution for repeated illegal entry attempts.

The announced measures will be implemented in close cooperation with regional partners, including the governments of the countries Mexico, Canada, Spain, Colombia and Guatemala.

It builds on the successful outcome of recent processes that have significantly reduced illegal border crossings through a combination of more legal routes and expeditious removal of those not using those legal routes.

The US government clarifies that it must be kept in mind that these measures do not replace the need for Congress to act in this situation.

“Only Congress will be able to provide the necessary reforms and resources to comprehensively manage the challenge posed by regional migration. Since taking office, President Biden has consistently urged Congress to pass legislation that updates and reforms our antiquated immigration system,” he announced.

The State Department and DHS are acting using the tools and resources available to them under current law, but inaction by Congress, which has neither approved nor funded the president’s plan, will exacerbate the challenge at the southwest border.

Measures

The announced measures include imposing stricter consequences for not using legal means.

The transition to re-applying Title 8 processing to all persons apprehended at the border will take effect immediately upon the termination of Title 42 orders. Persons who illegally cross the southwest border of the United States:

They will generally be processed under Title 8’s expedited removal authority in a matter of days.

They will be barred from re-entering the United States for at least five years if ordered removed.

They are presumed to be ineligible for asylum under the proposed Legal Route Avoidance Regulation, when there is no applicable exception.

To avoid these consequences, people are encouraged to use the many legal avenues that the United States has expanded over the past two years. The United States has announced several legal avenues, including the following:

Once the Title 42 order is no longer in effect, migrants in central and northern Mexico will have access to the CBPOne mobile app to make appointments and present themselves
These processes, once completed, will allow verified individuals who have approved family-based applications to enter the United States with this authorization. The United States Government will issue timely and effective clearances to those whose travel is approved and approved.

Persons entering the United States under the permit system after these processes would be eligible to apply for a work permit.

The United States will commit to accepting several thousand refugees each month from the Western Hemisphere, with the goal of doubling the number of refugees the United States has decided to accept under Los Angeles Declaration on Migration and Protection. To achieve this goal, the United States is working to improve the processing efficiency achieved over the past two years and to continue to increase the resources and personnel dedicated to the United States Refugee Admissions Program in this region.

On the other hand, the United States will continue to receive up to 30,000 people per month from Venezuela, Nicaragua, Cuba and Haiti as part of the expanded humanitarian parole processes announced earlier this year.

Border interceptions of people of these nationalities have dropped dramatically as DHS has expanded parole programs.

The United States will also continue to use its authority to continue to strengthen and expand other legal routes.tar before the port of entry, rather than attempting to enter the areas between those ports.

Additional appointments will be available through the CBPOne application, and the use of this tool will enable safe, orderly and humane processing.

DHS has created new parole procedures for family reunification El Salvador, Guatemala, Honduras and Colombia. The agency is also modernizing the existing procedures for issuing permits for family reunification in Cuba and Haiti.
