On the way home, Luise F.* (†12) died with multiple stab wounds. Her killers: two girls, 12 and 13 years old. The two minors are not threatened with punishment, the authorities in Germany stated during the press conference on Tuesday. Because: juvenile criminal law only applies to 14 years and older.

The two girls therefore cannot be punished. An indictment is impossible. However, the youth care agencies can order measures for the 14th birthday, for example accommodation in a youth house.

In Switzerland it is different. Here, children are already criminally responsible from their 10th birthday. This is where juvenile justice comes into play. However, the focus is not on punishment, but on deterring children and young people from further acts. Therefore, the punishments are much milder.

Prison only from the 15th birthday

Children up to the age of 15 usually receive a warning or have to do personal work, such as taking courses, for a maximum of 10 days. In addition, the child can be supervised and monitored. Offices and authorities, such as the Kesb, can also order accommodation in a home or with a foster family in particularly serious cases.

From the 15th birthday, prison sentences are possible in particularly serious cases, but only for a maximum of one year. From the age of 16, young people can spend up to four years behind bars.
