In UN court: Palestinians demand justice

Israel has been deliberately violating international law for decades, Riad al-Maliki said Monday before the United Nations highest court in The Hague. “The power of the law must prevail.”

The UN General Assembly has requested legal advice from the Court of Justice in 2022. The intention is to investigate to what extent the 57-year occupation is legal and what legal consequences arise from it. Although the report is not binding, it could further increase international pressure on Israel in the current Gaza war.

According to Palestine’s legal representatives, Israel has been violating international law since 1967 by annexing large areas of land and not granting Palestinians the right to self-determination.

A total of 52 states and three international organizations are participating in the six-day hearing – a record number in the court’s history. Israel itself does not want to speak, but to take a written position. It could take months for the report to be presented.

This hearing is not about the current war in the Gaza Strip, but about the Israeli occupation or control of the West Bank, Gaza Strip and East Jerusalem.

Israel captured the West Bank and East Jerusalem in 1967. Today, about 700,000 Israeli settlers live there, among the three million Palestinians. The Palestinians claim the areas for an independent state with East Jerusalem as its capital.

The United Nations granted Palestine observer status in 2012. Of the 193 UN member states, 139 have so far recognized Palestine as an independent state.

The hearing is also separate from the genocide case brought by South Africa against Israel over the Gaza war. In this case, the highest courts issued an interim decision at the end of January ordering Israel to do everything possible to prevent death, destruction and genocide in the Gaza Strip. Israel rejected South Africa’s accusations.
