Trump’s confrontation before the Supreme Court has begun: all of America trembles at this verdict

Now the fate of Donald Trump (77) lies in the hands of the Supreme Court of the United States. From Thursday, the nine judges will discuss whether or not the Republican will be approved as a presidential candidate on November 5.

A court in Denver ruled in December that Trump cannot run for office in the state of Colorado because of his role in the storming of the Capitol on January 6, 2021. Trump went ahead with the decision. The Washington Supreme Court’s ruling will have a huge impact on an already turbulent election year. Especially if the judges say that Trump is neither right nor wrong, but instead opt for a third option. There are even fears that riots will break out.

How do Trump’s opponents reason?

They refer to the 14th Amendment to the US Constitution. It states that no official of the United States who swore an oath to the Constitution and then participated in an insurrection may ever hold public office again. The law was enshrined in the Constitution in 1868 as a result of the American Civil War (1861-1865). It was intended to ensure that Confederate representatives who attempted to secede from the United States during the Civil War would never be able to regain political influence.

How does the ex-president defend himself?

Trump’s team says the US president is not affected by the 14th Amendment because it says nothing about “presidents” but only about representatives and officials. Moreover, the events of January 6 were not an uprising at all. And Trump didn’t incite the protesters either. His defenders point out that in his speech to his supporters, the then-president literally said, “I know all of you here will soon be marching to the Capitol to peacefully and patriotically express your views.”

What happens if Trump loses?

If at least five of the nine chief justices agree with their professional colleagues in Denver, Trump would be barred as a candidate nationwide and could never become president again. The verdict would be final and could therefore not be taken any further. Trump’s team warns that such a decision could lead to tumultuous circumstances in the country. More than 74 million Americans voted Republican in the 2020 election. A decision against Trump is likely to make some of them extremely angry. The storming of the Capitol three years ago showed that they are willing to use force against American institutions if necessary.

What happens if Trump wins?

A victory would give Trump a huge boost. He could tell people everywhere that the “witch hunt” the Democrats had launched against him had failed and that the forces trying to prevent his return to the instruments of power were nothing but corrupt losers. Trump will also likely try to label all other criminal cases against him as politically motivated acts of sabotage and denigrate the judicial authorities as democratically infiltrated enemies of the people.

What is the most likely verdict?

The Supreme Court must clarify a number of questions before reaching a decision: Is the U.S. president one of the “officers of the United States” listed in the 14th Amendment, or does this description not apply to him? Was January 6 really an uprising? And if so, did Trump really actively participate in it?

The next detail is also exciting: the constitutional amendment in question literally states that the oath-breaking revolutionaries may never “hold office” again, but not that they may never run for office again. The Supreme Court could give candidate Trump the green light. If he actually wins the election, the US Parliament, when it approves the votes on January 6, 2025, would have to decide whether to declare the election valid or not. Since January 6, 2021, we have known what scenes this scenario could lead to.

When will the decision come?

That is unclear. Theoretically, the four judges can take forever. However, her sentencing is expected before March 5. On this so-called “Super Tuesday” fifteen American states hold their primaries.
