Absurd law: widow pays for her husband’s deceased ex-wife

Gabriele Greif was happily married for 30 years and lived happily with her Manfred, her “Mr. Right,” she told “Bavarian Broadcasting.” Ultimately, her husband died three years ago and she received the inheritance and widow’s pension.

But something made her suspicious: 137.02 euros in pension benefits were deducted from her account – per month! These go to her husband’s ex-wife, who was married 40 years ago. The strange thing about it: the ex-wife is long dead, but Gabriele Greif has to pay the pension benefit and the state collects the money.

Duty is inherited, but not right

The explanation: When Manfred Greif’s first marriage failed, he had to pay her pension compensation for lost pension rights, normal until now. But then the ex-wife died. After her death, he filed a request to stop paying her, which was approved.

Now he died too – and the pension settlement appears again. Because: Manfred Greif left his wife the obligation to pay the damages, but not the right to apply to no longer have to pay. Only Manfred could do that. Gabriele Greif is furious and tells “BR”: “How is that supposed to work? A deceased person can no longer submit an application.”

The lawsuit was dismissed

She couldn’t have had to pay for a dead person. In total she has already paid more than 5,000 euros. She filed a lawsuit with the Regensburg Office and Administrative Court, but was rejected. The law gives the state its right.

Still, she doesn’t want to stop fighting. She has hired a lawyer and wants to take action against the absurd law. (neo)
