What happened on Saturday morning at the registry office in Vösendorf Castle (A) is difficult to believe. In the middle of the wedding ceremony of Hamza (27) and Gundula (40), about twelve officers from the Austrian immigration police stormed the room to arrest the Turk. Not because he had committed a crime, but because he was going to be deported at that moment.
The couple’s attorney posted the video on Facebook. It shows the shocked bride in the white dress talking to the officers. Her fiancé sits next to her in a suit and looks shocked at the officers. One of them says: “You have been arrested and must accompany us now.”
The German bride, who has lived in Austria for seventeen years, objects. “I have the right to get married, I have a date that is legally confirmed!” The officials remain strict: “But not today!” Hamza was taken away.
As “Today” reports, the Kurd was held in custody until Tuesday. On Tuesday he was finally deported – in his wedding suit. Replacement clothing did not reach him in time.
Gundula is in deep shock. She suffered a breakdown that same evening and had to seek psychological treatment. The 40-year-old told ‘Bild’ that she felt ‘terrible’. She was angry with the authorities. “The office had a thousand opportunities to catch us at work or at home to spare us this traumatic experience.”
Gregor Klemm, the lovers’ lawyer, is also shocked – and calls the authorities’ behavior ‘illegal’. There is no question of a marriage of convenience. That’s why he remains optimistic that the couple can get married in Turkey. Hamza could then return to Austria. «This is a very simple procedure that requires few documents. The deportation itself is not actually a reason to refuse.”
However, military service in Turkey is a problem. When he arrived at the airport, Hamza received a summons from the Turkish police. In two weeks he has to go to the army. There he could be threatened with a combat mission in the Syrian war zone.
But why was Hamza deported in the first place? He had friends, was integrated and worked as a chef in a restaurant near Vienna. There he met Gundula, who was working as a waitress at the time. They have been a couple for over a year and a half.
According to Oe24, Hamza applied for asylum in March 2022, which was ultimately rejected in December 2023 after several instances. As “Today” reports, citing attorney Klemm, the deportation became legally binding ten days before the wedding. There was therefore a valid arrest warrant.
However, the lawyer considers the manner in which the arrest took place unlawful. “This practice was declared illegal in 2018 and is completely inappropriate. “The two of them were trapped and the most beautiful day was ruined,” Klemm said. He has already filed a complaint about detention on behalf of his client.
The Federal Office for Immigration and Asylum (BFA) stated that there had already been thirteen arrest attempts before the wedding. These have all failed.
Bracket claims this is not true. These are “spread untruths” on the part of the authorities. He also emphasizes that Hamza would have been granted residence status after the wedding. “The BFA obviously wanted to prevent that with all its might.” (Mrs)
