The owners of the road demanded 50 euros in travel money from the couple. But they refused to pay. No wonder: only they have to pay. All other homeowners may use the path for free. So we went to court. However, the court agreed with the path owners.

The court also recognized that the couple was treated unfairly. The court said in its ruling that it was “actually completely nonsensical that the suspects would no longer be allowed to enter their building via the street, but via adjacent buildings.”

The couple should have claimed emergency right of passage

Nevertheless, the couple would have had a chance to put an end to the strange situation. You would then have had to request emergency priority from the real estate and management company. According to the court, the problem would have been legally resolved. However, that was not an option for the couple. Your lawyer told the “Kölner Stadtanzeiger”: “As a result, we would have given up our legal position and my clients would have been obliged to pay an emergency pension.”

However, for the city of Cologne it is clear that the company is obliged to transfer the rights to the path. The owners have until the end of January to respond to this plan.
