The Supreme Court accepts the case of Trump’s expulsion from the primaries

He US Supreme Court accepted the case on the expulsion of the former president for processing this Friday Donald Trump (2017-2021) republican primaries Colorado Republican Party.

The decision puts the court in the position of determining the national view on whether Trump can participate in the 2024 presidential election or, conversely, the role he played in Attack on the Capitol 2021 makes him ineligible.

In a brief court document, Supreme Court shows that the case has entered into proceedings and that nine judges will hold a public hearing today February 8 listen to the arguments of the parties.

The request for the High Court to review the case came from Trump’s legal team, which appealed the Court’s previous decision Colorado Supreme Court.

On December 19 of last year, in a ruling unprecedented in the history of the United States, the Supreme Court of Colorado ruled that Trump could not participate in the Republican primaries in that state because of his role in the attack on the Capitol.

Later, on December 28, Maine became the second state to disqualify Trump. In this case, the decision was made by the authority in charge of organizing elections in that constituency, the Maine Secretary of State, Democrat Shenna Bellows.

Trump’s legal team also appealed that decision by the Maine Secretary of State, in that case to that state’s Supreme Court.

In both cases, the authorities considered it so Trump participated in an attempted “coup”which disqualifies him from holding public office according to The third section of the 14th amendment to the Constitution.

That amendment was approved in 1868, after the United States Civil War, with the goal of preventing the rise to power of Southern Confederate rebels who swore to the Constitution and then betrayed it.

These decisions, in the absence of a decision by US Supreme Courtthey only affect Colorado and Maine because in the US federal system each state – not the nation – is responsible for holding elections.

Fifteen more states, incl Oregon, Virginia, New York or Nevadathey also decide whether Trump can run for office.

In the complex American political and electoral system, where states are responsible for organizing elections, even if they are presidential, each has its own laws and rules, so similar requests can have different outcomes.

This is where the Supreme Court becomes more important, since the judgment is by High Court It should be followed throughout the nation.

Six of the high court’s nine members are considered conservative, three of whom were nominated by Trump himself during his tenure, so it would be surprising if they disagreed with the former president.

However, the fact that some of them are followers of “originalism”, a legal current that advocates for the interpretation of the Constitution as the founders wrote it, casts doubt on the future decision of the Supreme Court.

Although a public hearing to study the case will be on February 8, it is not yet known when the US Supreme Court will issue its ruling and it is not known how far it will go.
