The Michigan Supreme Court refused to disqualify Donald Trump

TSupreme Court of Michigan He refused to disqualify this Wednesday former US President Donald Trump (2017-2021), a 2024 candidate for the White House for his role in the January 6, 2021 attack on the Capitol.

The Michigan ruling contradicts last week’s decision by the Colorado Supreme Court, which disqualified Trump from the 2024 election under the same legal premise.

The plaintiffs – who were ruled in their favor by Colorado in an unprecedented ruling – invoked the Constitution’s 14th Amendment, which bars people who participated in the rebellion from holding elected office.

This amendment was approved in 1868, after Civil War in the United Statesto prevent people associated with Southern Confederate rebels from coming to power.

Unlike in Colorado, in Michigan, judges argued that the case raised a political issue that should not be resolved by the judiciary and dismissed the lawsuit without even holding a trial.

These rulings only apply to Colorado and Michigan for now, since in the US federal system each state – not the nation – is responsible for organizing elections. Montana courts also dismissed a similar case.

Trump’s presidential campaign announced after the Colorado ruling that it intends to appeal to the United States Supreme Court to ensure that the former president is on the ballot in every state in the country.

“We have full confidence that the Supreme Court will quickly rule in our favor,” spokesman Steven Cheung said.

The move would leave the final decision on whether the 14th Amendment can be invoked in Trump’s case and whether he can run for president in 2024 in the hands of the Supreme Court — if it decides to accept the appeal.

The Republican primaries begin next January 15 with the Iowa primaries, and according to all polls, Trump is the favorite to face the current president, Democrat Joe Biden, again in the elections for the White House in November.
