The Supreme Court of the US state of Michigan has rejected an attempt by opponents of Donald Trump to remove the former US president from the primaries.
The court said on Wednesday that it was “not satisfied that the questions raised should be considered by this court.”
The ruling stands in stark contrast to a ruling by the Colorado Supreme Court. Last week, it ruled that Trump was unfit for the office of president due to his role in the storming of the Capitol on January 6, 2021, and therefore could not participate in the primaries.
Trump wants to return to the White House for the Republicans after the 2024 presidential elections. His opponents are trying to have Trump’s name removed from presidential election ballots in several states.
They argue for a constitutional amendment that would exclude people from elections who incited an ‘uprising’ against the constitution. So far, they’ve only had success in Colorado.
Unlike Colorado, the case never went to trial in Michigan. Corresponding lawsuits were dismissed by lower courts. So there was never a substantive dispute, but a question of jurisdiction. The state Supreme Court has now upheld the dismissal of the lawsuit.
The differing assessments from the top legal authorities in the two states should make it more likely that the U.S. Supreme Court will ultimately hear the issue.
Trump had announced that he would appeal the verdict in Colorado. The Colorado Supreme Court itself has stayed its decision until the issue is finally resolved on appeal. Trump’s name will likely be on the ballot for his party’s primary in the state early next year.
