In the dispute over the possible immunity of former US President Donald Trump (77) against accusations of election manipulation, the US Supreme Court has refused to hear the case at short notice.
The court on Friday rejected special counsel Jack Smith’s request to quickly resolve the immunity issue. The Supreme Court did not explain its decision in its one-sentence notice.
The Supreme Court’s decision represents a landmark victory for Trump: It likely means the start of his trial in a federal court in Washington on allegations of election manipulation will be delayed. So far, the plan is for this process to begin on March 4, in the middle of the Republican presidential primary. However, the procedure cannot take place without prior clarification of the issue of immunity.
Trump has repeatedly demanded that the trial not begin until after the presidential election on November 5. His lawyers therefore rely on delaying tactics.
Trump was indicted by the federal judiciary in early August over his efforts to overturn the results of the 2020 presidential election to remain in power. The ex-president’s lawyers counter that Trump has “absolute immunity” and cannot be prosecuted for actions that occurred during his term in the White House.
However, Federal Judge Tanya Chutkan rejected this argument on December 1. Trump’s four years as president “have not given him the divine right of kings to avoid the criminal liability to which his fellow citizens are subject,” she found.
Trump’s lawyers again appealed Chutkan’s decision. Special Prosecutor White then appealed to the Supreme Court on December 11. He asked the Supreme Court to hear the immunity issue directly, rather than waiting for the federal court decision that Trump’s lawyers appealed.
By bypassing the appeals court, White wanted to ensure that the trial could begin as scheduled on March 4. However, the current ruling of the Supreme Court means that the court of appeal must now hear the case first. Ultimately, the case will likely end up in the Supreme Court.
After the November 2020 elections, Trump refused to acknowledge his defeat by Democrat Joe Biden (81). Instead, he made accusations of widespread election fraud, which were often refuted. Trump’s campaign against his election defeat culminated in the attack on the Washington congressional seat by radical supporters of the elected incumbent president on January 6, 2021.
The current date for the start of the election manipulation process is one day before ‘Super Tuesday’, when the primaries to determine the candidates for the presidential election will take place on November 5 in about 15 states. According to the polls, Trump has the best chance of being nominated again by the Republicans.
Trump has already been charged in four criminal cases this year. A civil lawsuit is currently underway in New York over allegations that the entrepreneur overestimated the value of his real estate for years. (AFP)
