The motorcyclist races along the highway at 299 km/h. It is located on the left side of the three lanes. Suddenly a Skoda swerves to the left to overtake a tractor-trailer in the center lane at a speed of about 120 km/h. At an estimated speed of 190 km/h, the motorcyclist collides with the rear left of the vehicle and is seriously injured.
The accident took place on May 6, 2022 on the A9 near Allersberg in the German state of Bavaria. As part of a road safety campaign, the police in Middle Franconia shared a video of the accident on X last Monday. This leads to a discussion among users. ‘Who is to blame in this case? “Motorbike because it’s too fast, car because I didn’t look carefully when changing lanes?” someone asks.
Some are surprised, others are sure. “We agree that the motorist is primarily to blame,” says someone. But many see the blame lies with the motorcyclist: “Anyone who drives 300 km/h literally causes accidents. No one can see something like that in advance, it’s just tired of life,” writes one user.
The police also doubt the guilt. Police spokesman Christian Seiler told ‘Bild’: “When I overtake in my vehicle, I have to pay attention to the traffic behind me so that no one gets hurt.” And further: “In this case, the Skoda driver probably overlooked the engine.”
But according to the Central Franconia police, the motorcyclist is also not off the map: “At the same time, I have to adjust my speed on the highway so that I always have control of my vehicle.”
Criminal proceedings have been initiated against both parties involved. “Against the driver for dangerous bodily harm – against the motorcyclist on suspicion of a prohibited motor vehicle race,” Seiler said. “The motorcyclist was traveling at a speed of 299 km/h,” he explains. “You have to assume that he wanted to achieve the highest possible top speed.”
The court convicted the 21-year-old motorcyclist for a prohibited motor vehicle race. This is due to his “road-dangerous and reckless driving style”, as the spokeswoman for the Nuremberg-Fürth Public Prosecutor’s Office, Heike Klotz Bücher, told “Bild”. A prohibited race does not require a second vehicle. The driver from Nuremberg received a six-month suspension. He was also sentenced to a fine of 90 daily rates, so he had no criminal record.
The driver escaped unscathed. According to Klotz Bücher, the procedure was stopped: “There is no question of a crime on the part of the driver.” (gs)
