Tempo 30?: German police accidentally flash 104 “speeders”

The German police identified 104 suspected speed offenders in Herne in June 2022. 31 of them were fined and six of them even had to surrender their driver’s license. Many of them were probably wrong, as it turns out.

The supposed 1930s zone was actually a 1950s zone, as ‘Bild’ writes. However, unknown persons had placed a false sign with the speed limit of 30 km/h on the street in question. Even the local police did not notice the “joke” and therefore set the radar to 30 km/h.

Many of the drivers who were wrongfully ticketed have already paid their fines. But they probably won’t get their money back anytime soon. The city has so far refused to refund the wrongly collected fines. The reason: the objection periods have expired. The amount involved is more than 18,000 euros and several people affected have already contacted a lawyer.

A mercy procedure is conceivable

Herne city spokesperson Christoph Hüsken (48) explained to the “Westdeutsche Allgemeine Zeitung”: “The city of Herne sees no possibility of withdrawing the procedure within the scope of its legal responsibility.” However, there is the possibility of a so-called leniency procedure, in which the district administration can decide on procedures in which resumption is not possible.

The drivers who had to surrender their driving license have already submitted an application to the court and their proceedings must be “settled in the interests of those affected”. The unknown people who put up the fake sign will face criminal charges. However, they have not yet been located. (obf)
