The Starbucks group is facing a lawsuit from customers in the US because a number of fruit drinks contain flavorings instead of the fruit that gave them their name. A judge in New York ruled that the names and actual content could be misleading to consumers.
Judge John Cronan pointed out that the ‘Mango Dragon Fruit’ lemonade, for example, contained real dragon fruit, but only had mango as a flavouring. The difference was not clear to buyers from the names and advertisements, he emphasized in the decision published on Monday (local time). And unlike vanilla, it is not common for it to be a flavoring rather than the actual product.
Starbucks had filed a motion to dismiss the lawsuit filed about a year ago. The coffeehouse chain argued, among other things, that ‘reasonable’ consumers do not run the risk of being misled. Starbucks also pointed out that the drinks contained at least the flavors mentioned in the name as flavors and that customers could get further information from employees.
The plaintiffs said they were willing to pay higher prices for the drinks because they expected real fruit in them. (SDA)
