The Portuguese constitution forces the readmission of another critical militant from the far-right Chega

Banned member calls band leader André Ventura “gentrified”

The highest instance of the Portuguese Constitutional Court, which does not give grounds for appeal, is binding the far-right Portuguese party Chega to reintegrate the fourteenth militant expelled for “thought crime” into his formation.

Thus, 11 judges assessed the appeal of José Dias as “appropriate”, since the judicial body gave a reason for entertainment in the first instance a month ago. With the new penalty, the deliberations of the party’s Legal Council from January 13, when Dias was excluded, are declared null and void. The body explains that there should have been a “period during which the challenger cannot be readmitted to party membership” (which the statutes set between two and seven years).

It all started with an opinion that a member of the formation published on his Facebook profile, in which he accused the leader of the formation that Andre Venturabe “gentrification”the weekly states espresso. The comment cost him several internal suspensions, until he was kicked out a month later, in January.

After learning the verdict of the Constitutional Court, Dias declared that espresso that “justice has been satisfied with this decision. No one can be expelled for a crime of thought. What has no owner”.

José Dias became the vice-president of the party and currently heads the Technical Staff Union of the Public Security Police.

Just a few days before, last Friday, the TK also declared null and void the results of the fifth and to date last party convention, December 10, 2022, where Ventura was re-elected as leader. Namely, the part in which the election and business regulations were adopted was annulled, agreeing with the third third party, Fernando Marques, who challenged the meeting stating that illegal decisions were made, in accordance with the statute of the formation. This decision also puts Ventura’s re-election in question.
