A family has been living in Rangsdorf in Brandenburg for 10 years, the children go to school here. Your property covers approximately 1000 square meters, on which is the new-build home.
But now the bitter verdict of a court: the house must be demolished! And at the expense of the family. How did it come to this?
The story begins in 2010, when the family regularly acquired the property at a foreclosure auction in Luckenwalde court. The building land was auctioned because the heir to the property owed a debt to the city of Freiburg and was reportedly unavailable.
After the purchase, the family takes out a large loan, builds the house and moves in in 2012 with two small children, “Spiegel” reports. But suddenly the shock: the supposedly unavailable heir, an American with German roots living in Switzerland, comes forward. He owns the property and wants it back.
In fact, two courts now agree with him. The court did not search sufficiently for the heir. In his verdict, the judge hinted that the court was aware of the serious consequences this had for the family. But law is law.
The family must now, through no fault of their own, vacate their house and possessions within a year and have the house demolished at their own expense.
In addition, the family must pay the owner a compensation of about 6,000 euros for the use of the property. That’s not all. In addition, there is a base charge of 280,000 euros plus interest for the construction costs.
The family now hopes that the country will pay for the damage – after all, it was their fault. “We are waiting for an offer to talk,” says the father. (new)
