The defeat of Donald Trump was already certain in November 2020. But even as “Lame Duck President,” he still had the ability to appoint federal judges. There was an opening in Florida. Trump suggested Aileen Cannon, a largely unknown, then 38-year-old district judge. Because politicians and media at the time were concerned with the Big Lie, the alleged election manipulation, this nomination was de facto closed to the public. The Senate passed it by 56 votes to 21, and 12 Democrats voted.
Meanwhile, Judge Cannon is in the bright spotlight. She was randomly chosen to be the judge who will preside over Donald Trump’s landmark trial in Miami. That could be a windfall for the ex-president — and a catastrophe for the American rule of law. To understand why this is so, we need to elaborate on the American legal system.
Our image of American trials is shaped by Hollywood, by films and TV series in which a prosecutor or a lawyer manages to convince the jury thanks to a surprising witness or a brilliant speech. Unfortunately, this is largely fiction.
In reality, each indictment is preceded by a trial before a so-called grand jury. This is also a committee of lay people. The criminal authorities must convince them that they have sufficient evidence for a crime. Only then can a declaration be made.
When a grand jury issues an indictment, it usually means a conviction. In most cases there is therefore no spectacular trial before a jury, but a so-called “plea deal”. This means that the suspect partially pleads guilty and receives a lighter sentence. This procedure is standard, especially for national procedures. There, the chance of acquittal for a jury is only one percent.
Trump’s chances are probably even closer to zero given the overwhelming evidence Special Counsel Jack Smith presents in his indictment. Nevertheless, the ex-president pleaded “not guilty” at the first hearing in Miami court. That means there will be a jury trial. Trump has an important trump card up his sleeve: the aforementioned Judge Cannon.
Aileen Cannon is the daughter of Cuban immigrants who fled Fidel Castro’s regime. She attended Duke University and the University of Michigan Law School. She attracted attention early on with her conservative attitude. She is a member of the Federal Society, a powerful group of far-right lawyers. She also worked for Marco Rubio and Rick Scott, the two Republican senators from Florida.
Cannon is not in the spotlight for the first time. She was already presiding over Trump’s appeal after the search of his Mar-a-Lago residence last August. It was then that she decided in an almost scandalous way in favor of the ex-president. She had a special master deployed to check which of the seized documents the FBI was allowed to use.
With this verdict, the proceedings should have been postponed even then. However, it was overturned by the Court of Appeals soon after, with a staggering finding from Judge Cannon. The equally conservative judges of the Court of Appeals ironized Cannon, making it clear to her that even an ex-president cannot claim special treatment for himself.
Not only is Judge Cannon a conservative, she’s also recently in office. As the “New York Times” reports, she has led only four low-profile lawsuits. Julie O’Sullivan, a law professor at Georgetown University in Washington, explains: “She is both an inexperienced judge and a judge who has already indicated that she believes there are special rules for the former president. estimate what rules of procedure it will determine.”
O’Sullivan alludes to the fact that there will be many legal skirmishes before the actual trial begins. The court can exert a lot of influence on this. It may delay procedural matters and require additional clarifications. In short, you can’t get rid of the burden of proof against Trump. However, she may postpone the trial so long that the jury trial will not take place until after the November 2024 election.
This is precisely Trump’s stated tactic. He puts all the cards on his re-election. Then he would have a chance to pardon himself while launching a massive vendetta against Biden, the Democrats, the Deep State or whatever.
Trump knows he has no legal opportunities and relies on politics. So he begins biblically portraying himself as a martyr as he attacks Biden with increasing force. He describes the incumbent president as “corrupt” and the United States as a “banana republic”. He has the support of most Republicans and, of course, Fox News. The TV station even called Biden a “would-be dictator”.
However, it remains to be seen whether Judge Cannon will again dare to favor Trump in such an outrageous manner after the devastating reading of her conservative colleagues in the Court of Appeals. She would then have to take into account that she would have to withdraw from the case.
Even if there is a delay, Trump is still far from off the hook. Special counsel Smith continues to press the gas and yesterday on January 6, 2021, trotted two more witnesses before a grand jury in Washington. An indictment against the ex-president for voter fraud in the state of Georgia is about to be filed, and the case for paying hush money to porn star Stormy Daniels in Manhattan is already underway.
Trump is fighting for more than another move to the White House. There is a real risk that he will be sentenced to prison. He wants to prevent that at all costs – and that’s what makes him so dangerous.
