Birgit Lauda (44), the last wife of Formula 1 legend Niki Lauda († 70), who died in 2019, is fighting for the mandatory part of her inheritance at the Vienna Regional Civil Court. On Tuesday a first interim judgment was handed down, which according to the press release is not yet final, but Birgit Lauda supports her.

Consequently, Austrian law can be applied in the Lauda inheritance dispute. If a spouse or children are not named in the will, they are legally entitled to a compulsory portion of the estate. And that is exactly the case with the Lauda family. Because the ex-driver did not change his will after 2007. The wedding with Birgit took place only in 2008.

Under Austrian law, Birgit Lauda is entitled to one-sixth of the inheritance. With an estimated Lauda net worth of 200 to 500 million francs, that would be a double digit million that Lauda’s widow is now fighting in court. Compared to the “Krone”, Birgit Lauda’s lawyer Christoph Kerres says of the interlocutory judgment: “We are happy for our client with this success.”

The assets are in a private foundation

According to the magazine “Bunte”, Niki Lauda is said to have contributed a three-digit million to a private foundation for the benefit of his surviving relatives. So far, Birgit Lauda has not been able to get to her obligatory share – now she seems to be able to breathe easy.

On April 19, foundation board member Hais Asenbauer, Lauda’s former lawyer and friend, launched a counterattack. According to kurier.at, he wanted to have Birgit Lauda declared incompetent for inheritance and accused her of misappropriation of assets. Specifically, it concerned an art collection with about 50 photos and jewelry, which she would have kept secret. (fmu/srf)
