After much discussion, the court has issued a legal verdict in the FCL dispute. This time, just like in recent weeks, it is not about a pre-emptive right in the stadium issue. No, this time it is about the central question in this eternal legal dispute: it concerns approximately 25 percent of the shares in FCL Holding AG, which were withdrawn by Bernhard Alpstaeg at the general meeting in December 2022.

In defense, Alpstaeg filed several lawsuits after that general meeting. On the one hand, he requested re-registration in the share register by challenging the decisions of the aforementioned general meeting of FCL of December 21 – the procedure here is still pending. On the other hand, the investor, who recently turned 78, has filed a request for the appointment of an administrator due to organizational shortcomings in the club management.

Club sees itself confirmed

The latter has now been rejected by the court in a ruling dated October 12, 2023. “The Board of Directors is pleased with this decision and sees its decisions confirmed,” FCL Holding AG writes in a press release.

For the club, this decision makes it clear that “the positions mainly defended by Bernhard Alpstaeg, according to which the decisions of the general meeting of December 21, 2022 are null and void due to the deletion of 25% of the shares from the share register, are clear and clearly rejected.” are.

Alpstaeg is considering going further

When asked by Blick, Alpstaeg spokesperson Sacha Widdorovits said that the investor is currently considering pursuing the court’s decision. Economic reasons, among other things, were decisive for the submitted application. “At the end of the 2021/22 season, the board of directors of FCL Holding AG had already burned the last cent of the new share capital of 6.6 million francs raised a year and a half earlier, demonstrating that it was unable to manage the problems. FCL in an economically sustainable way.”
