Fine for the beating scandal: Hertha goalkeeper Gersbeck does not have to go to prison

Marius Gersbeck was sentenced to a fine of 40,000 euros on Thursday.

In mid-July there was a major scandal at the Hertha BSC training camp in Zell am See. Goalkeeper Marius Gersbeck (28) fought with a 22-year-old during an unauthorized night excursion and caused the victim to suffer an eye socket fracture with his punches and kicks. the maxillary sinus wall and a hematoma of the eyelid.

Now it is clear: Gersbeck does not have to go to prison. Proceedings against the 28-year-old were halted at the Salzburg Regional Court on Thursday on the condition that he pay a fine of 40,000 euros. This principle of ‘diversion’ is enshrined in Austrian law. He paid the fine directly into the court treasury during the trial.

Gersbeck reached an agreement with the victim

The responsible public prosecutor had charged the goalkeeper with serious bodily harm. The verdict is not legally binding for the time being, because the public prosecutor has the option to appeal within 14 days. Meanwhile, Gersbeck had already reached an out-of-court agreement with the victim in advance and is said to have paid him damages in the order of six figures.

The goalkeeper showed remorse in court: “I deeply regret the incident. And I would like to personally apologize to the victim,” he is said to have said in court, according to “Bild”. There was also a handshake with the victim.

Hertha’s second chance?

It is unclear what will happen next for Gersbeck at Hertha. “Our player has not been criminally convicted and has compensated the injured party by mutual agreement. In this situation, taking into account the interests of everyone involved, we do not rule out that Marius Gersbeck will be given a second chance. We will discuss this internally and decide quickly,” said Thomas E. Herrich, Managing Director of Hertha BSC.

Gersbeck had only returned from Karlsruher SC to his boyhood club Hertha in the summer. (AFP/bjl)
