In order to levy the global minimum tax for large international companies in Switzerland, the Federal Council is planning a so-called one-stop shop: the most economically important unit of a group of companies must pay the tax for all units in Switzerland in its canton.

On Wednesday, the state government opened consultations on further provisions of the regulation, which temporarily introduces the global minimum tax of 15 percent in Switzerland. A new additional tax will be introduced in Switzerland for this purpose.

According to the Federal Council, the canton transfers to the Confederation and the cantons where other business units of the same group of companies are located contribute their share of the additional tax revenue. According to the state government, this should minimize the administrative burden.

According to the draft ordinance, the procedure must take place electronically on a portal. The Swiss Federal Tax Office (ESTV) and the concerned cantons have access to this portal. The appeals procedure stipulates that complaints about the assessment must be addressed directly to the Federal Administrative Court.

Schedule unchanged

The condition for the introduction of the OECD minimum tax is a yes from the people and the cantons on 18 June. The Swiss electorate then votes on the necessary constitutional basis for this.

The current schedule will be maintained. The minimum tax regulation is expected to enter into force on January 1, 2024, the Federal Council writes. Before making a final decision, he will check the implementation status in other countries.

From the point of view of the Federal Council, the aim should be for the minimum tax to come into force at the same time as the EU’s. EU finance ministers agreed on a minimum tax last December. By the end of 2023, Member States must have transposed them into national law. (SDA)
