Bundesrat suddenly against litter ban

Litter is a problem in many Swiss cities.

In the future it should be possible to fine anyone who throws their cigarette on the street or leaves their PET bottle in the park. The Commission for Environment, Spatial Planning and Energy of the National Council (Urek-N) advocates a national uniform litter ban. Violators will be fined 300 francs.

Many cantons already have a litter ban. But it is federalism, as always: there is a maze of laws, and the problem is not uniformly regulated anywhere. The national solution that has now been introduced is also intended to standardize the fines regime of the cantons.

Litter – The competence lies with the cantons

Litter is already penalized in some Swiss cantons, at least in theory. Only: the cantonal laws are not uniform.

Litter offenders in the cantons of Aargau and Solothurn can already be fined 300 francs. The canton of Schwyz, on the other hand, has different bus fares. Whoever leaves waste in a residential area pays 80 francs, litter in forests and meadows is punished with 250 francs. In the canton of Fribourg there is a risk of a fine of 50 francs. In Basel-Stadt and Appenzell Innerrhoden, the prohibited disposal of waste costs 100 francs each.

It is different in the canton of Appenzell Ausserrhoden, where litter is not fined. The canton of Zurich is also interesting: there, as in Bern, the fine is CHF 80. The SVP wanted to bring about a stricter litter law through a parliamentary initiative and demanded a fine of 200 francs. However, the project failed in the cantonal council.

All parties are in favour, except for a few SVP politicians. They want the ban removed from the current draft environmental law, as reported by the “SonntagsZeitung”. The bill will go to parliament in May.

The Federal Council has changed its mind

Until now, it seemed that the Bundesrat would support a national litter ban. In 2016, he thought fines for litter for the whole of Switzerland were still sensible. Now the Federal Council has suddenly changed direction, writes the “SonntagsZeitung”.

In the current statement, the government supports the course of the SVP. It says that no national litter law is needed because most cantons already have their own litter ban.

For the Greens, the scapegoat for the Federal Council’s change of course was quickly found: Albert Rösti (55), Minister for the Environment since the beginning of this year. On their Rösti monitoring blog uvekwatch.ch they write that Rösti has put the Federal Council on the SVP course.

The Bundesrat not only changed its mind about the litter ban

According to the Greens, the litter ban is not the only point in the current bill with which Rösti has managed to change the mind of the Federal Council. He also succeeded, for example, with the so-called resource platforms. They are designed to encourage the reuse of waste material.

Unlike the Greens, the SVP is pleased that Environment Minister Rösti can assert himself in the Federal Council, the article in the “SonntagsZeitung” continues. Mike Egger (30), SVP National Councilor and member of the Environment Committee, can be quoted as saying: “Of course I hope and am also convinced that Environment Minister Rösti can assert himself in the Federal Council.”

However, it is difficult to assess whether and to what extent Rösti has actually succeeded in changing the mind of the Bundesrat on these points: the meetings of the Bundesrat are secret. (Okay)
