“Switzerland must decide”

According to international law expert Oliver Diggelmann, the sale of a tank would involve Switzerland in Ukraine’s military support logistics.

The fact that Germany wants to buy our mothballed Leopard 2 main battle tanks is currently being hotly debated in Switzerland. For international law expert Oliver Diggelmann (55) it is clear: “Switzerland must decide whether it wants to get involved in this military dimension,” the professor of international law, European law, public law and philosophy of state at the University of Zurich told the Tamedia newspapers.

With a sale, Switzerland would become part of Ukraine’s military support logistics. Filling the gaps created by supporting Ukraine should strengthen Germany militarily and create new space for support, the expert continued. “It doesn’t matter if a German goes to Ukraine for every tank delivered.”

“It is unclear exactly where that limit lies”

Under international law, Germany is currently a non-belligerent country that provides military support to Ukraine, Diggelmann said. However, if at some point this support became a central part of Ukrainian military operations, Germany itself would become a belligerent country. “It is unclear exactly where that limit lies in science. If Germany exceeds them, tank deliveries are excluded from the start under the law of neutrality.

Germany has asked Switzerland to buy stored Leopard 2 main battle tanks, it was announced on Friday. They are intended to replace tanks that Germany and other EU countries have supplied to Ukraine. The approval of parliament is required for a sale. Such a company never had a chance there. (SDA)
