Transparency at a football match was the reason: hatred against women – National Council wants strict punishments

Anyone who publicly calls for hatred or discrimination against a person because of their gender should be punished with a prison sentence of up to three years or a fine. Six politicians demanded this in six identical proposals in the parliament in Bern.

They therefore called for an amendment to the Criminal Code. In particular, discrimination and incitement to hatred on grounds of gender should be criminalized. So far, Article 261 of the law you mentioned only prohibits discrimination against people because of their race, ethnicity, religion or sexual orientation. The Grand Chamber supported the demand on Wednesday – with 123 yes votes to 65 no votes.

Football fans gave a boost

The reason for the claims was a banner on the Winterthur Schützenwiese during the football derby against Schaffhausen in May 2019. It read: “Winti Fraue figgä und verhahne”. The poster was shocking on the sidelines, but had no legal consequences for the six fans affected. They were acquitted; the court justified this with the lack of urgency of the message.

This made politicians so angry that they are now demanding a change in the law: women are disproportionately the target of violence and hatred on the internet, in the family environment, at work, at school and in their free time, but also on the street. “A clear signal is needed here,” SP Zurich MP Min Li Marti (49) said in a statement. FDP state councilor Jacqueline de Quattro (63), Center councilor Marianne Binder-Keller (65) and GLP politician Kathrin Bertschy (44) also called for a change in the law.

In her view, an extension of criminal law would send a clear signal that calls for violence and hatred based on gender would not be tolerated, nor would calls for violence based on racist, anti-Semitic or homophobic reasons, De Quattro told the Council.

The SVP saw no urgency

Only the SVP in the National Council spoke out against the amendment to the criminal code. Spokeswoman Barbara Steinemann (47) points out that facts that apply to hate already exist. Moreover, not every unpleasant behavior needs to be punished in the Criminal Code.

The responsible committee of the Council of States will then deal with it. She did not approve the initiatives last May by a vote of 6 to 4 with one abstention. (she)
