Major errors discovered in assessments by PMEDA: This is what you need to do if your IV report has shortcomings

An IV report can decide your existence. Sounds dramatic, but it’s true. Depending on how things turn out, you will receive more or less pension, or no pension at all. As the affected person, you are practically at the mercy of the expert body’s decision. You would think that the assessment should be all the more responsible.

This was not the case with the assessment body PMEDA. This is evident from a study by the Federal Commission for Quality Assurance in Medical Reviews (EKQMB). She advises insurers to no longer use PMEDA for reporting. The IV has responded to this request and is terminating the collaboration. It is still unclear whether daily health and accident insurance will follow suit.

Criticized for years

Disability associations and patient advocates have long criticized the PMEDA. The observer also reported on the poor quality of the reports. There are many examples, says lawyer Luzius Hafen, who regularly represents people in court who file a lawsuit against IV reports.

As an example he cites the case of a manager in a large company. He was examined for burnout. The examination by a PMEDA psychiatrist lasted barely half an hour and he declared the man fully fit for work. Daily allowances or even an IV pension were stopped or never paid out.

It was only years later that a second report confirmed that the man had a serious personality disorder, including delusions, paving the way for a disability pension. The man was financially ruined by the incorrect declaration. For Hafen, the EKQMB finding is “a success in the fight for better quality reporting.” He criticizes the fact that it took so long.

Take legal action

What can those affected do? “Anyone who is in an ongoing procedure involving the PMEDA should definitely hire a lawyer now – if they have not already done so,” says lawyer Hafen. In this way, a pension can still be saved. In cases that have already been legally concluded, things become more complicated. The Federal Social Insurance Agency takes the position that the courts have carefully examined the facts and the PMEDA reports accordingly. Therefore nothing can be done now.

“In my opinion that is wrong,” says Hafen. He assumes that the EKQMB has also discovered incorrect reports from legally binding cases. “I advise those involved to contact a legal expenses insurer, a specialized lawyer or the UP legal advice center.” The last word does not seem to have been spoken yet.
