Baume-Schneider explains it himself: Asylum despite sympathies for the rulers of Eritrea

There were wild scenes this weekend at an Eritrea event in Stuttgart, Germany. 27 police personnel, several participants in the regime-related event and two Eritreans from the opposition were injured in riots. A total of 300 police officers were present. Apparently Eritreans also came from Switzerland.

The phenomenon of supporters and opponents of the Eritrean government fighting with each other is also an issue here. It was not until early September that Eritreans attacked each other in the canton of Zurich. The subject does not leave politics in this country untouched.

That is why SVP politicians wanted to know on Monday from the responsible Minister of Justice, Elisabeth Baume-Schneider (59), what she was doing to commemorate the crime in order to stop violence among Eritreans in this country.

Asylum will only be withdrawn if a serious crime has been committed

SVP National Councilor Benjamin Fischer (32) asked the Federal Council what he was doing to defuse this domestic conflict involving Eritrean migrants.

Switzerland does not know how many Eritrean refugees support the current regime in Eritrea. “A large part of the Eritrean diaspora is not politically active,” says Elisabeth Baume-Schneider in the response.

A residence or settlement permit can only be revoked if someone “significantly, repeatedly or seriously violates public safety,” the federal councilor said in her response on Monday.

However, asylum can only be withdrawn if a refugee is legally convicted of a crime with a minimum sentence of three years, Baume-Schneider said. The act must also be regarded as particularly reprehensible. “Participation in regime-friendly events alone – even if there are riots – will likely not be sufficient to meet these legal requirements,” Baume-Schneider said.

No mediation between dispute adjudicators

However, the cantons can impose police measures based on their jurisdiction, such as district bans. However, the federal government does not have the authority to ban or restrict diaspora events. The federal government cannot act as a mediator, the Minister of Justice continued. The topic should now be discussed in more detail in the safety core group.

The Federal Office for Migration (SEM) emphasized to Blick weeks ago that European countries have no option for forced repatriation because Eritrea is not cooperating. Nevertheless, the Asylum Act allows local authorities to withdraw or reject asylum or refugee status in certain cases. Especially when Switzerland’s internal and external security is at risk.
