Zurich man convicted: he had compared Tamara Funiciello to Hitler

SP council member Tamara Funiciello (33) has to keep reading online hateful comments about herself. But the Bernerin does not let this sit on her – and reports her to the police.

A man from the Zurich Oberland also had to learn that. His Facebook comment has legal ramifications for him. The 50-year-old was sentenced according to the “Zürcher Oberländer”.

The reason for his insult on Facebook was the AHV vote in September 2022, in which the retirement age for women was raised from 64 to 65 years. The next day, Funiciello wrote on Facebook that the “white, old men” were responsible for the vote result.

Convicted of libel

The man then indirectly compared the politician to Hitler. The convict also wrote that “there are many parallels with you” – without mentioning the name of the dictator.

The public prosecutor’s office in Uster has now closed the proceedings with an order subject to periodic penalty payments. According to the final decision, the Oberlander was convicted of slander and libel. He was given a suspended fine of 25 daily rates of CHF 150 each. He must also pay 800 francs in court costs.

Even though the Facebook user had never directly compared the politician to Hitler, but only indirectly, it was clear to the prosecutor what was meant. According to the sentence, the man deliberately linked Funiciello’s reaction to the result of the vote “with the terrible time of National Socialism in Germany”.
