Due to restrictions on repatriations: Commission against torture criticizes Swiss authorities

The National Commission to Prevent Torture (NKPT) said on Thursday that parents were bound in front of their children. In the Commission’s view coercive measures should only be used if there is a risk of injury to yourself or others. In general, she assessed the handling of the forced returnees as “professional and respectful”.

Last year, the NKVF supervised 28 forced returns by air from the highest enforcement level 4 (special flights) and 22 forced returns from enforcement levels 2 and 3.

Avoid restrictions as much as possible

On behalf of SP federal council member Elisabeth Baume-Schneider (59) and the chairmanship of the Conference of Cantonal Directors of Justice and Police, the Expert Committee on Return and Execution of Expulsion (FA R+WwV) wrote a statement about the NKVF report.

The FA R+WwV also believes that the use of coercive measures should be avoided as much as possible, according to the statement. However, a general exemption from shackles, for example in the case of families, would mean that the enforcement of legally binding removal orders would no longer be possible in these case constellations. Furthermore, it is primarily in the hands of the parents to prevent the use of coercion by cooperating with the enforcers.

The FA R+WwV also stressed that special flights would only be used as a last resort. Namely when the persons who were obliged to leave the country have not made use of the option to leave the country voluntarily. As a rule, those affected would have prevented at least one repatriation due to their behavior in the past. (SDA)
