Criminal case related to Corona leaks: mistakes made by special detective Marti remain unpunished

The case against Special Counsel Peter Marti has been dropped.

Special Investigator Peter Marti himself is being targeted by a Special Investigator for his unauthorized investigations into the Corona leaks. According to the accusation, the extraordinary public prosecutor Marti abused his office and violated professional secrecy.

But now it is known: the criminal case against Marti has been stopped. Special Investigator Stephan Zimmerli announced that Marti’s behavior was not criminal.

Suspected of overthrowing the government

It was Peter Lauener, the former spokesman for federal councilor Alain Berset, who filed criminal charges against Marti. Marti was actually deployed to find out how a confidential report about the crypto affair ended up in the media. But the special investigator soon had a very different focus. He suspected Lauener of actually planning an overthrow of the government. Namely by passing on information about the Federal Council’s corona policy to publisher Ringier, to which Blick also belongs.

Marti had been investigating him behind Lauener’s back and asking for e-mails. Finally, he had the speaker arrested.

No claim has been substantiated

Lauener and another plaintiff accused the special investigator of acting outside his jurisdiction and usurping his office, or even abusing his office.

An accusation that Special Detective Zimmerli now rejects. Marti received permission to extend the procedure. He also did not make himself punishable by demanding data from e-mail providers. Although, as Zimmerli writes, Marti’s conduct “did not follow the recommendations of legal scholarship and the latest jurisprudence” and “was unlikely to withstand judicial review.” So Zimmerli suggests that Lauener’s currently sealed emails should probably remain under lock and key.

The termination of the procedure is not yet legally binding. This can be appealed to the Federal Criminal Court.

Marti left the service last May for “personal reasons” after heavy criticism of his work. The federal prosecutor’s office has taken over the proceedings against Berset’s ex-spokesperson Lauener. (lha)
