The Council of States wants to allow juvenile delinquents to be taken into custody under certain conditions. He approved an amendment to the Juvenile Justice Act.

According to the draft, only juveniles who have committed murder after the age of 16 may be detained. At the end of the juvenile justice system, there must also be a serious risk that they will commit such an offense again.

The Juvenile Criminal Law Act currently does not provide for mere security measures such as detention for the protection of third parties. According to the Bundesrat, the assistance provision, which can be requested following a protection measure under juvenile criminal law, is not intended as a security measure for persons who cannot be brought up or treated.

Twelve teenagers convicted of murder

According to the Federal Council message, it is not the 16 or 17 year olds who should be taken into custody, but juvenile murderers who have reached the age of 18 after juvenile detention. According to the Federal Council, twelve young people were convicted of murder in Switzerland between 2010 and 2020. For most of them, there was no great danger for third parties after release from prison.

The template goes back to a motion by FDP State Councilor Andrea Caroni (43), who referred the federal councilors to the Bundesrat. He then worked out a template. The Council of States approved it without discussion on Thursday.

No more unaccompanied holidays

The Council of States also approved an amendment to the Criminal Code. The point is that criminals who are in detention or who have previously been in prison no longer go on holiday unaccompanied.

This change is also mainly the result of a parliamentary initiative. It comes from former SVP National Councilor Natalie Rickli (46). Zurich’s current government councilor was referring to a rapist and murderer held in custody who had managed to temporarily escape through a so-called humanitarian exit. Such is not responsible.

On the other hand, the Council of States rejected the proposal to only provide for an annual review of the detention of criminals every three years if parole had previously been rejected three times in a row. This bill will also go to the National Council. (SDA)
