His idea could go haywire. A young man candidly told the “SonntagsZeitung” that he had changed his official gender to a woman to escape military service.

Since 2022 it is possible to change the official gender in this country quite unbureaucratically. A young man benefited from this, although gender reassignment is actually reserved for people with a trans identity or a variant of gender development.

“Bring the rule ad absurdum”

The young man is a member of the SVP and also wanted to protest with his sex change against the new law that allows a sex change without any medical or psychological evidence. “I wanted to take this new regulation ad absurdum,” he told the “SonntagsZeitung”.

But now the 23-year-old has to worry about legal ramifications. According to the Federal Bureau of Justice, such a procedure is illegal – if it really happened and is found. “Abusive or reckless statements about gender reassignment will not be tolerated and will not be tolerated,” a spokeswoman said.

Under criminal law, such conduct may be classified as fraudulently obtaining a false certification. Under the Penal Code, this is punishable by imprisonment for up to five years or a fine.

But ultimately it is the job of the judge to decide when there is an abusive or reckless statement, the spokeswoman told Blick.

No cases of abuse known

Across Switzerland, 1,171 people had their gender changed last year. Nothing is known about the number of abuses. According to the Federal Office of Justice, the civil registry authorities are obliged to report any suspicion.

The University of Freiburg is currently being commissioned to analyze the new legal provision, also with a view to abuse cases.

An unimaginable case for Keller-Sutter

Justice Minister Karin Keller-Sutter (59) said in the political debate three years ago in parliament that she had not expected the new regulation to be so brutally exploited one day: “I cannot imagine that a young man would just complains because of the Compulsory military service as a woman in the register of civil status.»

The concerns came completely out of the blue, she said at the time: “These people change everything, the whole identity. They turn their lives upside down. No one just does that.”

The plan didn’t work for the young man anyway. A few months after his gender change on paper, he still received his marching orders. He didn’t adjust to being a woman until after he was enlisted – that’s why he was already drafted into the army, meaning he should have served as a woman too.

But he simply did not feel like going to the recruiting school and with the help of a psychiatrist, he was rejected.
