The federal government must pay a foundation several million in damages.

The dispute, which the Federal Administrative Court has now clarified, concerns a case from 2001. In 1998, a founder named the foundation she founded as her sole heir. The federal government does not disclose which foundation it concerns.

After her death in 2000, previously unknown accounts of the founder appeared with amounts in the tens of millions. As a result, a member of the Board of Directors personally claimed part of these funds: these funds belonged to him personally. The conflict escalated and threatened to jeopardize the work of the foundation.

Courts conceded out-of-court settlement

The counsel who clarified the matter suggested that the money be divided amicably: the foundation would receive a share and the share would go to the board. The Federal Foundation Supervisory Board (ESA), part of the Ministry of the Interior, approved this agreement at the end of 2001.

However, the judge later overturned the decision: the foundation board member had no rightful claim to the funds allocated to him. The foundation suffered a loss of about twelve million francs.

Confederation decides not to go to Lausanne

On May 2, 2023, the Federal Administrative Court ruled that the federal government had to pay the foundation almost six million francs in damages plus interest, or about ten million francs.

The Ministry of the Interior and the Ministry of Finance have decided not to appeal to the Federal Supreme Court – and are now paying the foundation about CHF 10 million. (SDA/sf)
