The councils still do not agree on how to deal with so-called cybergrooming. Last week, the National Council tacitly decided to criminalize cybergrooming.
Commission president Carlo Sommaruga (SP/GE) justified the renewed rejection by the Council of States on Monday with demarcation problems. The current legal framework is also sufficient to punish such acts. Now it is the turn of the National Council.
The councils already agreed on the core of the proposal, a new definition of the crime of rape. This keeps the “no is no” true, but if a victim doesn’t express their rejection due to a state of shock or frostbite, this is also judged a “no.”
It is also controversial whether sex offenders are required to participate in prevention and learning programs. Where the Council of States in any case prefers an optional formulation and a court decision, the National Council wants a fundamental obligation. He only wants to allow exceptions in individual cases.
Now it’s the turn of the great room. If there is no consensus after this final round of deliberations, a consensus conference should address the outstanding issues.
