According to a decision of the EU court, “Emmental” cheese does not necessarily have to come from Switzerland. The EU court dismissed the relevant lawsuit filed by Swiss industrial company Emmentaler Switzerland in Luxembourg on Wednesday. They wanted to protect the “Emmentaler” name as a trademark in the EU.
The association wanted to ensure that only Swiss Emmentaler could be labeled as such with the lawsuit filed. In the case of a cheese that does not come from Switzerland, the region of origin should be named, for example, Allgäuer Emmental. For this, the organization filed a lawsuit against the European Union Intellectual Property Office.
The Luxembourg judges have now denied this. Emmental describes a type of cheese “for the concerned German people”, not its geographical origin. Therefore, the term cannot be protected as a trademark.
The decision can still be appealed before the European Court of Justice, Europe’s highest court. (SDA/kae)
