Apple wins ‘Fortnite’ dispute

They found an error in identifying the relevant market – but classified it as unimportant, according to the ruling published on Monday.

“Fortnite” developer company Epic wanted to avoid the 30 percent tax on the purchase price that Apple withheld from transactions in the App Store. It hit number one in 2021: A version of the app was hijacked from the side of app inspectors, where users could also buy virtual items after Apple.

Apple kicked the “Fortnite” app from the App Store for violation of rules. Epic later accused Apple of unfair competition, but lost in most cases in district court.

But at the same time, the appeals court left in effect a lower court ruling that Apple needed to make it easier for app developers to specify purchase options outside of the app store. The iPhone group wanted to reverse that.
