There was an explosion in the Zurich courts this morning. The high court overturned the verdict against former Raiffeisen banker Pierin Vincenz, 67, and other defendants, awarding them compensation and criticizing the indictment in unusually harsh terms.
A disgrace for the Zurich prosecutor’s office. But he doesn’t want to accept it that way. He has now commented on the dismissal of the case in a press release.
Initially, the prosecutor’s office noted that the high court had not yet announced its decision and that this information was only available through the media and an anonymized version of the decision on the Internet. Strange.
The prosecutor then flatly denies claims that the indictment was “too detailed” and that the co-defendant did not receive the indictment in his native French. Because the accusation was understood by all parties and questioned privately. The French-speaking defendant also confirmed at the main hearing before the Zurich District Court that he understood the indictment and had discussed it with his defence.
For these reasons, an “excessively time-consuming” repetition of the entire first instance trial is not appropriate from the prosecutor’s point of view. Accordingly, he will file a complaint with the Federal Court against the rejection decision.
The prosecutor’s office will not provide further information or conduct interviews due to the ongoing investigation.
