Due to a shortage of teachers, Raymond Diebold, at age 71, still helps out in classrooms regularly. In November he alternated between Pfäffikon ZH and Winterthur ZH. One morning, shortly before seven o’clock, the crowd was so large that he had difficulty boarding the train. The way to the second-class compartment is closed, he says.
But it was impossible for him to stand; He had just had hip surgery on his left side and his right foot was broken. The way to first class was free and there were seats. So Diebold limped there. “The idea was that I would move to sophomore year as soon as a spot opened up.”
Events turned out differently. “As soon as I sat down, two inspectors came and complained that I didn’t have a real ticket.” His poor health and lack of a place in the second class didn’t concern him. “You said SBB is not obliged to offer seats to passengers.” Diebold had to pay an additional fee: 140 francs plus 5 francs for the change of class.
Calling the contact center and a doctor’s note changed nothing. Diebold is annoyed: “Nobody could explain to me how I could get from point A to point B legally and on time in this situation.” In return, he was told they had waived criminal charges “as a gesture of good faith.” Diebold is a “repeat offender”. Two years ago he was traveling without a ticket. “I forgot my public subscription had expired.”
It is clear to him that SBB is right. However, he thinks he has been treated unfairly. “There was no malice behind my crimes.”
What rules does SBB actually have regarding tolerance? Does it depend on the good will of individual employees, or is there some kind of guidance within the company? It is said that each case is examined individually upon request and equal treatment is central. And: “There is no right to good faith.”
Driving without a valid ticket is a violation of the Passenger Transportation Act. In principle, a first-time report is possible, but subsequent class changes are not possible on self-controlled trains. So Raymond Diebold would have no choice but to go out again and arrive late to class as a teacher.
