Lakeside house foreclosed – Aargau resident no longer knows what to do: retiree Silvia H. struggles to stay in her dream apartment

Silvia H.* (72) is in a desperate situation. “Scammers took everything from me. “I even have a roof over my head now,” she laments. She currently lives in a beautiful one-room apartment on a magnificent estate on the shores of Lake Geneva. Unless another miracle happens, he will have to vacate the place after the foreclosure auction in the coming weeks.

Silvia H. grew up in Aargau, graduated from KV, later worked as a tour guide on cruise ships and speaks several foreign languages. Later, through his work as an office manager, he moved to St. Louis in the mid-1990s. Gingolph earned enough money in VS to realize a dream: He bought a 30 square meter flat with a boat dock in a former doctor’s villa.

Compared to today’s prices, it was a bargain: he paid 190,000 francs at the time. There was also a fee of 10,000 francs for parking at the hotel’s own port and 25,000 francs for a boat mooring.

He will now spend his weekends and holidays at his lakeside dream destination. And during the week they live in their rented flat in Aargau. The three-act drama begins.

Act One: Purchase

H., “The fraudsters did not let me enter the boat location on the title deed!” says. When he bought the flat in 1994, the then condominium seller and manager suggested that he take the purchase contract to the land registry office and register the contract there. “I was defrauded,” Ms. H. says in an interview today when she presented all the contracts to Blick.

As H. said, the fraudster had registered the boat location not in his own name, but in the name of his wife’s daughter. And this despite the fact that in the contract the position of the boat is indicated in black and white. This situation still has its effect today, 29 years later. “Boat docks are now rare on Lake Geneva; most can only be rented,” says Silvia H.

Therefore, he suspects that at the foreclosure auction, his flat with a boat lot will fetch 250,000 francs more than its then price. It says: “There is a 20-year waiting list for boat spots on Lake Geneva.” According to Ms. H., the current manager of the condominium owners also refused to properly register the trough area. The manager did not want to comment on Blick.

Second act: Additional costs

After retiring, the single woman moved her entire home from Aargau to Lake Geneva. He soon had a bad feeling about the property’s management, which was carried out by a manager appointed by neighbours.

The vendor and manager increased maintenance amounts on a regular basis. They once started with 12,000 francs, in 2015 it was 40,000 francs, and then the maintenance of the property would cost a full 60,000 francs a year.

He began to suspect that this also greatly increased H.’s rate. “Maintenance work was either not done or was done inadequately,” said the woman from Aargau. It was also observed that insurance benefits were not paid to the accounts of the flat owners. He had no way of obtaining billing details despite repeated requests. It is also said that there are no detailed protocols. H.’s comments were never recorded. It was run by the flat owners because they refused to pay the maintenance fee.

This led to a court date in the spring of 2020, which he was unable to attend due to a two-week hospital stay. H. is of the opinion that decisions were made against his interests in his absence. Ultimately, debt collection led to the foreclosure of the one-bedroom apartment in August 2023. The enforcement office at Monthey VS does not want to comment on the case but confirms the sale went through.

Act Three: Foreclosure Auction

H. believes the sale was manipulated: “The additional costs of 10,000 francs per year included in the sales documents were ‘fatal’.” The manager gave incorrect information to the appraiser. This is why sales documents are full of errors. Retiree: “No consideration was given to the absolute uniqueness of the property in the sales documents.”

H. therefore suspects that there was very little interest in the property, only two people bidding, and that is why the price was so low. Eventually the property passed to its new owner for 203,000 francs. Sad point: His apartment now belongs to the then-seller’s heir; According to the seller, he cheated on her when he bought this flat 29 years ago.

Ms. H. had to apply to social services due to her low sales income. She is in poor health and does not yet know where she will live in the future. She still wants to stay in her Lake Geneva apartment as long as possible and defend herself from being kicked out. The single woman jokingly says: “If a man has something like this, contact me!”

Then she gets emotional again and starts crying: “I can’t imagine leaving here.” It is important for Blick to be able to send his message to his readers: “Dear property owners, check whether everything is entered correctly in the land register.”
