Nicole Schönmann has been helping a friend who has been mentally ill for a while. He has a company in the Bern region and everything is getting too much for him. A bill of about 120 francs for a company registration also sank. “He probably didn’t know what it was about anymore,” says Schönmann.

Now a debt collection agency steps in and adds various things to the bill: 97 francs for “income and expenses”, 75 francs for the “lump sum”, 25 francs for the “collateral receivables”. Thus, 120 exceeded 300 francs.

Nicole Schönmann researched: Only the principal amount and interest on outstanding debt are paid – there is no legal or contractual basis for the rest. It notifies the collection institution with a sample letter from the observer. This responds with lengthy, lawful explanations such as “damage according to the theory of difference” or “breach of contract according to Article 97 et al. OR”. Schönmann is unsure: is there something owed?

No, the Observer Advice Center provides it. The gruesome legal requirements don’t change the fact that your friend doesn’t have to pay fees in excess of 198 francs. It is sufficient to object to these in writing once. You no longer have to respond to other reminders.

Nicole Schönmann was relieved. “This letter from the debt collection office makes a very strong impression,” she says. He knows that when the next bill arrives, it will go to waste paper.
