After the Supreme Court of Justice (CSJ) declared that the articles of the Family Code, which establishes that marriage is between a man and a woman and prohibits marriage between persons of the same sex, are not unconstitutional, Luis Eduardo Sagel (known as Pin Pin the Clown) has convinced that justice satisfied, as the “struggle” waged by various groups against “gay marriage” is reaffirmed.
In a letter titled “Everyone’s Struggle Was Not in Vain,” Sagel explained that justice had arrived “after more than seven years of fighting to prevent the approval of same-sex or gay marriage in Panama.”

Under the presentation of the magistrate Maria Eugenia Lopez Ariasthe plenary session of the CSJ concluded that “norms that stipulate that marriage must be voluntarily agreed upon between a man and a womanlegally capable of merging, creating and sharing a common life, and those that at the same time prohibit people of the same sex from marrying each other (Article 34 number 1 of the Family Law and 35 of the Code of Private International Law), are objectively and reasonably justified in the general interest to give priority to those communities with the potential to establish a family, they give continuity to the human species and, therefore, to society”.
The verdict indicates that there is a reality, namely that until now the right to equal marriage It is nothing more than an aspiration that, although legitimate for the groups involved, It does not have the category of human right, nor does it have a fundamental rightsince it has no conventional and constitutional recognition.
