Shakira was accused of defrauding another 6 million in Spain

Spanish prosecutors accuse Colombian singer Shakira of defrauding the state treasury of more than 6 million euros in 2018 income and property tax returns, using a corporate network based in tax havens.

That’s what he claims public ministry Spanish in the lawsuit he filed 3 months ago against the artist -already informed at his home in Miami-, which led the court in Barcelona to open a second case against her, for two crimes against the State Treasury.

Specifically, the lawsuit claims that the singer cheated Tax agency Spain’s 5.3 million in personal income tax (IRPF), which corresponds to the income he received from his “El Dorado” tour in 2018 and from the transfer of his intellectual rights, and another 773,600 euros in wealth tax on the 12 million he owns in real estate and financial assets.

In order to defraud the Treasury, the defendant used the corporate network and presented “false statements” of income tax, in which he failed to declare income and deduct expenses that were not applicable, thus he managed to reduce the amount paid to the treasury.

According to the lawsuit, Shakira collected a portion of the income she received from her transfer music rights through a company incorporated in Luxembourg with which he signed several “simulated contracts”, so that he benefited from “very reduced” taxation, which in the financial year 2018 was 1.39%.

That Luxembourg company, according to the opinion Prosecutor’s office“it was just a company registered only for tax purposes” that did not perform any activity, except “only formal and administrative intervention”.

It was also stated in the lawsuit that Shakira He used another instrumental company, founded in Spain in 2017, to “calculate the income and expenses corresponding” to his “El Dorado” tour – which included 53 concerts in 22 countries – despite the fact that the company also had no real activities.

Furthermore, the public ministry believes that Shakira deducted an additional seven million from her companies’ expenses, in some cases because they were counted in duplicate, and in others because the payments were of a “distinctly personal” nature.

Among those personal expenses that the Prosecutor’s Office considers non-deductible trips appear individuals by private plane – 150,483 euros -, as well as plane tickets for their two children and their teacher.

Shakira is awaiting trial for another tax fraud report filed against her by the state attorney in 2018, and the proceedings continued despite the artist returning 17.2 million euros Tax agency -the amount allegedly defrauded plus interest-, after knowing that it was being investigated.

In this process, the Prosecutor’s Office is asking for a sentence of eight years and two months in prison and a fine of HRK 23.8 million for the Colombian singer.
