The Supreme Court confirmed two years in prison for the directors of CAM for dishonest management

The verdict of the Criminal Council thus rejected the appeal of both of them, who were also sentenced to 5 years of a special ban on holding any position, employment or occupation within or on behalf of banking entity or a loan from Spain.

The High Court, with the presentation of Judge Juan Ramón Berdugo, recalls that in its judgment from 2020, the National Court also convicted the owners and legal representatives of Valfensal, Juan Vicente Ferri Guardiola and José Salvador Baldó Llorens, as instigators of the crime of dishonest administration and three others against the State treasury, with a reduction in compensation for the damage caused and the analogy of admitting the facts, to a total of 2 years in prison and a fine of three million euros for each of them, which they did not appeal to the Supreme Court.

In terms of civil liability, the judgment now confirmed establishes that López Abad and Gil Mallebrera jointly and severally indemnify the Deposit Guarantee Fund in the amount of 28 million euros, to which must be added the appropriate statutory interest, declaring direct civil liability of the insurance company Caser up to a limit of HRK 15 million.

In the confirmed verdict, the State Court considered it proven that the two former executives caused very serious damage to the bank through a series of risky operations that forced FROB make a series of cash injections to alleviate this mismanagement. He accuses them of putting the interests of third parties before the interests of the entity.
